Terms of Service

Welcome to FairKitty. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing, or using FairKitty (the "Service"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years of age to use FairKitty. By using the Service, you represent that you meet this requirement. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use of your account.

You may also use FairKitty without creating an account via shared group links. In this case, you are responsible for keeping your group access links secure.

4. What FairKitty Is (and Isn't)

FairKitty is an expense-splitting tool that helps groups track and settle shared costs. It is not a financial institution, payment processor, or financial advisor. We do not process payments between users — we only track and calculate balances.

We do not guarantee the accuracy of expense calculations where users have entered incorrect data. Users are responsible for verifying their own expense entries.

5. Acceptable Use

You agree to use the Service in compliance with all applicable laws and our Acceptable Use Policy. You must not use FairKitty for fraud, money laundering, harassment, or any illegal purpose.

6. Intellectual Property

FairKitty and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the data you enter into FairKitty (expense descriptions, group names, etc.). By using the Service, you grant us a limited licence to process your data solely for the purpose of providing the Service.

7. Plans and Billing

FairKitty offers a free tier and paid Pro plans. Paid plans are billed in Australian Dollars (AUD) and include GST where applicable.

  • Monthly and Annual plans renew automatically unless cancelled before the end of the billing period.

All payments are processed securely by Stripe. We do not store your payment card details.

8. Cancellation and Refunds

  • Monthly plan: Cancel anytime. Access continues until the end of the current billing period. No partial refund for remaining days.
  • Annual plan: Cancel anytime. Access continues until the end of the annual period. No refund.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

You may export your data or delete your account at any time. See our Privacy Policy for details on data retention and deletion.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

FairKitty is not responsible for disputes between group members about expenses, payments, or settlements. We provide the tool — the financial arrangements are between you and your group.

11. Limitation of Liability

To the maximum extent permitted by applicable law, FairKitty shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

12. Termination

We may suspend or terminate your access to the Service at any time for violations of these Terms or our Acceptable Use Policy. We will provide notice where practicable. You may terminate your account at any time through your account settings.

13. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days notice via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
